By accessing, browsing, or using Wellbeing Through Health's website, patient portal, mobile interfaces, or healthcare services, you acknowledge that you have read, understood, and agree to these Terms. These Terms apply to all users including patients, visitors, and authorized representatives.
You must be at least 18 years old to establish care independently. Minors require consent from a parent or legal guardian. You must provide accurate, complete, and current information. We reserve the right to verify age, identity, and insurance eligibility at any time.
Wellbeing Through Health does not provide emergency medical care. If you are experiencing a medical emergency (chest pain, difficulty breathing, severe bleeding, loss of consciousness), call 911 immediately or go to the nearest emergency room. Our patient portal and messaging systems are not monitored 24/7 for urgent needs.
We provide primary care, telehealth consultations, specialist referrals, preventive health services, chronic disease management, mental health support, and wellness programs. Clinical services are delivered by licensed independent practitioners who follow their own professional standards and clinical judgment.
By accepting these Terms, you acknowledge that you have been informed about the potential benefits, risks, and alternatives to recommended treatments. You agree to disclose all relevant health information including medications, allergies, and medical history. You may withdraw consent at any time.
Licensed practitioners (physicians, nurse practitioners, physician assistants) are independent contractors or employed clinicians, each responsible for their own clinical judgments and treatment decisions. Wellbeing Through Health facilitates coordination but does not direct or interfere with independent clinical practice.
Appointments are subject to provider availability. We require 24 hours' notice for cancellations or rescheduling. Late cancellations (less than 24 hours) incur a $50 fee. No-shows without any notice incur the full appointment fee. Exceptions made for genuine emergencies at our discretion.
Payment is due at time of service unless insurance verification is completed in advance. We accept credit cards, debit cards, HSA, FSA, and cash. For approved insurance plans, we will bill your carrier directly. You remain responsible for any copays, deductibles, or uncovered amounts.
Balances unpaid after 60 days may accrue interest at 1.5% monthly (18% APR). Accounts over 90 days past due may be referred to a collections agency. You are responsible for any collection costs or legal fees incurred to recover unpaid balances as permitted by USA law.
We make reasonable efforts to verify insurance coverage but cannot guarantee benefits or payment amounts. Coverage determinations are made by your insurance carrier. You are responsible for understanding your plan's benefits, limitations, and out-of-network policies. We are not liable for coverage denials.
Prescriptions are issued at practitioner discretion based on clinical need. We comply with all federal and state controlled substance regulations. You are responsible for disclosing all current medications to avoid adverse interactions. We do not prescribe controlled substances via telehealth in all states.
Our patient portal provides secure messaging, appointment scheduling, telehealth visits, and record access. You are responsible for maintaining account confidentiality. Messages are not for emergencies. We may communicate with you via email, SMS, or portal notifications as permitted by your consent and applicable law.
Wellbeing Through Health does not guarantee specific health outcomes. Individual responses to treatments vary based on genetics, adherence, concurrent conditions, and other factors. Testimonials on our website reflect individual experiences and are not guarantees of your results. Past outcomes do not predict future results.
Services are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses. Some jurisdictions do not allow warranty disclaimers.
To the maximum extent permitted by USA law, Wellbeing Through Health's total liability for any claim arising from these Terms or your use of our services is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages including lost wages, pain and suffering, or loss of health improvement expectations.
You agree to indemnify and hold Wellbeing Through Health harmless from any claims, damages, or expenses arising from your violation of these Terms, your failure to disclose health information, your misuse of our services, or your infringement of any third-party rights including medical malpractice claims against independent practitioners.
These Terms are governed by the laws of the United States of America , without regard to conflict of laws principles. Any dispute arising from these Terms shall be governed by USA law and applicable federal law including HIPAA and the Affordable Care Act.
Any dispute shall first be attempted to resolve informally for 30 days. If unresolved, disputes shall be resolved through binding arbitration under AAA Consumer Arbitration Rules in USA. You waive the right to a jury trial and class actions. For permitted court proceedings, venue shall be in Rockland County, NY.
We may suspend or terminate your patient relationship for violation of these Terms, non-payment, fraud, abusive behavior, insurance fraud, or as required by law. You may terminate at any time by providing written notice. Upon termination, you remain liable for outstanding fees and may request medical record transfer.
These Terms constitute the entire agreement between you and Wellbeing Through Health.
